Hopefully you have already seen the press about the major review of all current claims of Personal Independence Payments. This is great news for claimants and for advisers who have been supporting people who have experienced injustice during the claiming process.
The challenge was taken by the Public Law Project on behalf of claimants who had been refused PIP despite their mental health issues meaning that travelling was difficult/impossible for them. It was noted that this is discriminatory in that mental health and physical health issues were being given different ‘status’ when the impact on the individual was the same or very similar – they could not go out, or once out might not be able to continue a journey.
The government has chosen not to appeal against the court decision which is a great triumph for the advocates who have been working tirelessly to bring these cases to justice. The next thing to find out is how the reviews will take place and how legislation and guidelines will change so that people are treated fairly in the future.
Meanwhile, we can all rejoice that injustice was noted, challenged and reversed… excellent work PLP 🙂
